Terms of Service & Acceptable Use

1. Agreement
These Terms of Service (the "Terms") govern your access to and use of ParalonCloud (the "Service"). By creating an account, renting an instance, or otherwise using the Service, you agree to these Terms and to the Acceptable Use Policy below. If you do not agree, do not use the Service.
2. The Service
ParalonCloud is a decentralized GPU compute network. Compute instances are hosted on hardware operated by independent third-party providers, not by ParalonCloud. You are renting time on machines you do not own and that you do not have exclusive physical control over. You are responsible for evaluating the suitability of an instance for your workload.
3. Acceptable Use Policy
You agree to use the Service only for lawful purposes and to respect the providers whose hardware you use. You must not use the Service to:
- create, store, or distribute illegal content of any kind, including child sexual abuse material (CSAM) or other content that exploits or endangers minors;
- engage in unauthorized access, hacking, credential theft, port scanning, denial-of-service (DoS/DDoS) attacks, botnets, or other network abuse;
- send spam, run phishing or fraud operations, or develop or distribute malware;
- infringe intellectual-property rights or violate the privacy of others;
- attempt to access, tamper with, or interfere with the host system, other tenants, or the provider's infrastructure beyond your rented instance;
- violate any applicable law, regulation, or sanctions.
4. Enforcement
We may suspend or terminate a session or account, with or without notice, if we reasonably believe it violates these Terms or the Acceptable Use Policy, or to protect the Service, a provider, or third parties. Serious violations — including illegal activity — may be reported to the affected provider and to the appropriate authorities. Terminations for violations are not eligible for refund.
5. Your Content & Data
You are solely responsible for the code, data, and content you run or store on an instance. Because instances run on independent third-party hardware and are ephemeral, an instance and its disk are wiped when the rental ends, and may be lost on restart of running processes. Do not store data you cannot afford to lose; checkpoint long-running jobs and download anything you wish to keep before your rental ends. We do not guarantee the confidentiality, integrity, or availability of data stored on rented instances.
6. Provider Hardware & Maintenance
Hardware made available on the ParalonCloud network is owned, operated, and maintained exclusively by its providers. If you participate as a provider, you are solely responsible for the condition, safety, and proper functioning of your equipment, including without limitation:
- the electrical installation and power supply your equipment is connected to;
- adequate cooling, airflow, and ventilation of the machine and its environment;
- thermal management of components, including the condition of thermal paste, heatsinks, and fans on CPUs and GPUs;
- regular cleaning and protection against dust accumulation;
- operating the equipment within the manufacturer's specifications and applicable safety standards.
You acknowledge that offering hardware for rentals and compute workloads places sustained load on your equipment, which may result in elevated temperatures and normal component wear. ParalonCloud does not monitor, control, or assume any responsibility for the physical health of provider hardware, and is not liable for any damage to, degradation of, or failure of such hardware — including damage caused by overheating, inadequate cooling or ventilation, degraded thermal interfaces, dust accumulation, power surges, or faulty electrical installations — nor for any resulting repair costs, losses, or downtime.
7. Payments
Rentals are billed according to the pricing shown at checkout. Credits and charges are described at the point of purchase. Except where required by law or expressly stated, fees are non-refundable.
8. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service or any instance will be uninterrupted, secure, error-free, or that hardware operated by independent providers will meet your requirements.
9. Limitation of Liability
To the maximum extent permitted by law, ParalonCloud and its providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or revenue, arising from or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid for the rental giving rise to the claim.
10. Indemnification
You agree to indemnify and hold harmless ParalonCloud and its providers from any claims, damages, liabilities, and expenses arising from your use of the Service or your violation of these Terms.
11. Changes
We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
